Terms of Service

Kling Flash (klingflash.com) is an independent third-party tool. It is not affiliated with, endorsed by, or operated by Kuaishou, Kling AI, or any other AI model provider. Product and model names are used descriptively.

These Terms of Service ("Terms") are an agreement between you and the operator of klingflash.com ("we", "us", "our"). They govern your use of the website, the web app, the developer API, and every related feature (together, the "Service"). By creating an account, buying credits, or otherwise using the Service, you agree to these Terms, our Privacy Policy, our Acceptable Use Policy, and our Refund Policy. If you do not agree, do not use the Service.

1. Eligibility and Accounts

• You must be legally able to enter into this agreement, and you may use the Service only for lawful personal or business purposes.
• You can sign in with Google, GitHub, or an email address and password. Keep your credentials private. Everything done through your account is your responsibility until you tell us it has been compromised.
• Keep your account details accurate. One person, one account: creating extra accounts to collect free credits, sign-up bonuses, or check-in rewards is not allowed.
• If you use the Service for a company or a client, you confirm that you are authorised to accept these Terms on their behalf.

2. Credits, Subscriptions, and Payment

• Generation is paid for with credits. The credit cost of a video or image generation is shown before you start it and may change as models and pricing change.
• We sell credits as subscriptions (billed monthly or yearly) and as one-time credit packs. Prices, currencies, and included credits are those shown at checkout.
• Subscriptions renew automatically at the end of each billing period until you cancel. Cancel at any time from your account settings; you keep access until the end of the period you have paid for, and no further charge is made.
• Subscription credits are valid for 30 days from the day they are added and do not carry over. Credits from one-time credit packs do not expire, unless the offer you bought states a validity period.
• Free credits, sign-up bonuses, check-in rewards, and promotional credits have no cash value, may expire, and may be changed or withdrawn at any time.
• Payments are processed by Stripe. We never see or store your full card number. Applicable taxes and any payment fees are shown before you confirm.
• If a generation fails because of an error on our side or on the model provider's side, the credits it used are returned to your balance automatically.
• Refunds are governed by our Refund Policy. Beyond what that policy provides or the law requires, purchases are final.
• Credits are personal to your account. They cannot be transferred, sold, or exchanged for money.

3. Your Inputs and Outputs

"Inputs" are the prompts, reference images, audio, and other material you submit. "Outputs" are the videos, images, and audio the Service generates for you.

• You keep whatever rights you have in your Inputs. You are responsible for them, and you confirm that you hold every right, licence, and consent needed to upload them and to have them processed — including the consent of any real person whose face, body, or voice appears in them.
• Subject to these Terms and to the model provider's own usage policies, you may use your Outputs for personal and commercial purposes. We claim no ownership of your Outputs.
• You grant us a limited licence to host, store, process, transmit, and display your Inputs and Outputs only as needed to run the Service for you, to keep the Service secure, to investigate abuse, and to comply with the law. We do not use your Inputs or Outputs to train AI models.
• AI outputs are generated from patterns, not facts. They may be inaccurate, may resemble outputs other users receive, and may not be protected by copyright in every country. Review them before you rely on them or publish them.
• Outputs stay available in your account for a reasonable time, but we do not promise permanent storage. Download anything you want to keep.

4. Content Rules

Our Acceptable Use Policy is part of these Terms. In short, you may not use the Service to create, upload, or share:

• sexual or pornographic content of any kind;
• any sexual or exploitative content involving minors, or content that presents minors in an age-inappropriate way;
• intimate imagery of a real person without their consent, sexual deepfakes, or a real person's face or voice used in a way they have not agreed to;
• content meant to deceive — fake footage or recordings of real people or events presented as genuine, fraud, or impersonation;
• content that harasses, threatens, or promotes hatred, violence, self-harm, or extremism;
• anything that infringes someone else's copyright, trademark, privacy, or publicity rights, or that breaks the law.

We use automated filters — our own and the model providers' — to detect violations, and review accounts by hand when a problem is reported or detected.

5. Prohibited Conduct

Do not:

• try to bypass or weaken safety filters, moderation, rate limits, or access controls;
• access the Service with bots, scrapers, or scripts other than the official developer API used under your own API key;
• share, rent, resell, or sublicense your account, API key, or credits, or offer the Service to others as if it were your own;
• reverse engineer, copy, or build a competing service from the Service or its content;
• overload, disrupt, or probe the Service or its infrastructure;
• open a payment dispute instead of contacting us first when something goes wrong with a purchase.

6. Developer API

If you use the developer API, your API key is tied to your account and your credits. You are responsible for keeping it secret and for every request made with it. The API is subject to the rate limits published on the API page and to these Terms, including the Acceptable Use Policy.

7. Moderation and Enforcement

We may refuse a prompt, block or delete an Output, freeze credits, suspend or terminate an account, or cancel a subscription when we reasonably believe there is a safety, legal, fraud, or policy risk. Accounts closed for breaking these Terms or the Acceptable Use Policy lose access to stored Outputs and remaining credits, and are not eligible for a refund. We may preserve and share information with law enforcement where the law requires or permits it.

8. Third-Party Models and Service Availability

Generation requests are routed to third-party AI model providers and infrastructure partners. Which models are available, how fast they run, the quality of their results, and how they moderate content can change at any time and are outside our control. We do not promise that any particular model, feature, resolution, or output format will remain available, and we may modify, suspend, or discontinue any part of the Service. We will give reasonable notice of changes that materially reduce what a paid plan includes.

9. Our Content and Brand

The Service itself — its design, code, text, and the klingflash.com name and logo — belongs to us or our licensors. Nothing in these Terms gives you a right to use it except as needed to use the Service. "Kling", "Kling AI", "Kuaishou", and other model and company names are trademarks of their respective owners and are used here only to describe what the Service connects to.

10. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that Outputs will be accurate, original, or suitable for any purpose.

11. Limitation of Liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to the Service. Our total liability for all claims relating to the Service is limited to the amount you paid us in the twelve months before the event giving rise to the claim. Some jurisdictions do not allow these limits, in which case they apply only as far as the law permits.

12. Your Responsibility for Claims

You will defend and compensate us against claims, losses, and costs (including reasonable legal fees) arising from your Inputs, your Outputs, your use of the Service, or your breach of these Terms — for example, a claim by a person whose likeness or work you used without permission.

13. Termination

You can stop using the Service at any time and delete your account from Settings → Security. Deleting your account deletes your generation history and forfeits any remaining credits; our Privacy Policy explains what happens to stored files. We may suspend or terminate access as described in Section 7. Sections that by their nature should survive — including 3, 7, and 9 to 15 — continue to apply after termination.

14. Changes to These Terms

We may update these Terms as the Service, the models we connect to, or the law changes. The date at the top shows the latest revision. Material changes will be announced on the Service or by email before they take effect. Using the Service after a change takes effect means you accept the updated Terms.

15. Disputes and Contact

If you have a problem with the Service, contact us first at support@klingflash.com or through our contact page — most issues can be sorted out quickly that way. Any dispute that cannot be resolved this way is governed by the laws of the place where the operator of the Service is established, without regard to conflict-of-law rules, except where mandatory consumer protection law in your country provides otherwise.
